Definitions

1. “The Company” refers to ATS AUTOMATED I&C CENTERS.
2. “The Customer” refers to the person, partnership, Limited Company, or other legal entity, who agrees to services being provided by ATS AUTOMATED I&C CENTERS.
3. “The Conditions” refers to the terms and conditions of ATS AUTOMATED I&C CENTERS operations, set out in this document and any special terms and conditions agreed in writing by a Director, Company Secretary, or other member of this company’s management team, acting for and on behalf of ATS AUTOMATED I&C CENTERS.

Conditions

1. These Conditions shall apply to all contracts for any service provided by the Company to the Customer, to the exclusion of all other terms and conditions, including any terms and conditions the Customer may purport to apply under any purchase order, confirmation of order, or similar document.
2. Agreement of any work to be carried out by ATS AUTOMATED I&C CENTERS shall be deemed conclusive evidence of the Customer acceptance of these Conditions.
3. Low tyre pressure.

The Price and Payment

1. The price of the service provided shall be the price agreed between the Company and the Customer, at the time the Customer agrees to Fitness Test being carried out. This price may vary, dependent upon any change in new legislation, which is beyond the control of the Company. The price of the Fitness Test carried out is subject to service tax. Where applicable, Service tax shall be due at the rate ruling on the date that the service tax invoice is drawn.
2. Payment of the price and service tax shall be due at point of entry of vehicle at the time of booking on line in case of telephone booking the payment will be payable by credit or debit card or in case of booking at the test centre will be payable at the time of booking.
3. The Fitness Test fee is non refundable including if Customer fails or cancel the appointment.

Credit Terms

1. There will be no Credit Terms, the Company reserves the right to refuse to provide any of its test centre services to the Customer if the full payment is not made at the time of booking.

Risk

1. Any Fitness Test carried out by the Company at the request of the Customer, will be at the Customer’s risk from the collection of the vehicle from parking until the completion of Test. In no event company will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising while vehicle is on the premises.

Disputes procedure and Jurisdiction

1. Any and all contracts entered into between the Company and the Customer shall be governed by the laws of Delhi and all disputes arising out of any contract between the Company and the Customer shall be subject to the exclusive jurisdiction of the courts of Delhi. In the event that the Customer is dissatisfied with any service carried out by the Company, the Customer should first make contact with the Company in order to try and resolve the matter. The Company has a complaints procedure in place.-It also complies with the Data Protection Act.
